Introduction

Surekh Kant Baxy is a key member of Aekom’s Disputes team with more than 8 years of experience. He is a litigation and arbitration practitioner with a broad practice across commercial disputes, infrastructure and construction arbitration, insolvency and restructuring, corporate and shareholder disputes, constitutional litigation, regulatory proceedings and statutory advisory.

His work spans appearances and advisory before the Supreme Court of India, various High Courts including Delhi, Bombay, Madhya Pradesh, Andhra Pradesh, Karnataka and Telangana, the NCLT, NCLAT, Arbitral Tribunals, regulatory authorities, consumer fora and Civil Courts across India.

  • Advising SMS India Pvt. Ltd. in construction arbitration involving delay, escalation, and interpretation of technical specifications.
  • Representing Patanjali Foods Limited and group entities in multi-million arbitration proceedings from Section 9 stage through arbitral proceedings and post-award challenge strategy.
  • Advising the Kanwar Group in civil construction arbitrations against entities such as NTPC and Doosan involving EPC contracts, delay claims and liquidated damages.
  • Advising the Dhanuka Group in shareholder arbitration involving issues relating to enforceability of shareholders’ agreements.
  • Advising Lemon Tree Hotels in arbitration concerning hotel management contracts and operational control.
  • Advising the Hero Munjal Group in arbitration arising out of family disputes.
  • Representing large number of individual and corporate clients before the Delhi High Court and district courts in suits seeking permanent injunctions, mandatory injunctions, summary suits for recovery, and declaratory reliefs.
  • Advising TripAdvisor India and TripAdvisor LLC on trademark disputes before the Delhi High Court and Bombay High Court and assisting in civil litigation strategy relating to platform liability.
  • Advising promoters and corporate groups in oppression and mismanagement proceedings involving issues of control, governance and minority rights.
  • Advising B. Braun in settlement of shareholder disputes and related proceedings involving State authorities.
  • Advising the RDS Group in oppression and mismanagement proceedings and facilitating a negotiated family settlement.
  • Advising in writ and quash proceedings before the High Courts at Delhi, Gwalior, Jabalpur, Andhra Pradesh, Jaipur, Telangana, Madras and Karnataka on issues relating to insolvency, taxation, RDBA and land and revenue laws.
  • Advising TripAdvisor in writ proceedings before the Bombay High Court on intermediary liability and regulatory overreach.
  • Representing the Pavilion Interior Group in writ proceedings before the Delhi High Court against the Ministry of External Affairs.

Insolvency & Bankruptcy

  • Advising on insolvency petitions before the NCLT Delhi, Mumbai, Chennai, Karnataka, with focus on maintainability, creditor strategy and impact on parallel disputes, including advisory on Section 32A of the IBC.
  • Advising the Kotsons Group on insolvency proceedings from initiation through resolution.
  • Advising the Eros Group on the acquisition of the James Hotel as a going concern under the IBC.

General Corporate & Regulatory Affairs

  • Advising clients on securities law matters before SEBI and the Securities Appellate Tribunal, Mumbai, including disputes involving allegations of round-tripping and evergreening.
  • Advising SIDBI in matters before the NCDRC, DRT, NCLAT and the Supreme Court involving insolvency and recovery.
  • Advising TripAdvisor India and TripAdvisor LLC on compliance under the Information Technology Rules, including intermediary obligations and the Grievance Officer framework.
